Building Trust Through Clear Agreements

1. Acceptance of Terms

By accessing or using the websites, products, or services provided by Beej Technologies ("Beej", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree with any part of the terms, you must not use our services.

2. Services Overview

Beej provides custom software development, AI integration, automation, and consulting solutions. Service descriptions, deliverables, and timelines are defined in project proposals or statements of work agreed between Beej and the client.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of any account credentials used to access our services.
• You agree to promptly notify us of any unauthorized access or security breach involving your account.
• You confirm that all information provided to Beej is accurate, complete, and up to date.

4. Intellectual Property

Unless otherwise stated in a written agreement, Beej retains ownership of all pre-existing intellectual property, tools, methodologies, and frameworks used in delivering services. Custom deliverables created for a client become that client's property once full payment is received, subject to any licensing obligations specified in the governing agreement.

5. Payment Terms

• Project fees, billing milestones, and expenses are outlined in the applicable proposal or statement of work.
• Unless otherwise agreed, invoices are due within fifteen (15) days of issuance.
• Late payments may incur interest charges or suspension of services until outstanding balances are settled.

6. Confidentiality

Each party agrees to protect confidential information disclosed by the other party and to use such information solely for the purpose of delivering or receiving the contracted services. Confidentiality obligations continue for three (3) years following termination of the relationship, unless otherwise required by law.

7. Data Protection

Beej processes personal data in accordance with applicable privacy laws and our Privacy Policy. By using our services, you consent to the collection and use of information as described in that policy.

8. Warranties & Disclaimers

• Beej will deliver services with reasonable care and skill consistent with industry standards.
• Except as expressly provided, our services are offered "as is" without warranties of any kind, either express or implied.
• We do not guarantee that delivered software will be free from minor defects or that operation will be uninterrupted.

9. Limitation of Liability

To the fullest extent permitted by law, Beej shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business, or data. Our total liability for any claim arising out of or relating to the services is limited to the amount you paid for the specific services giving rise to the claim.

10. Termination

Either party may terminate an engagement for convenience with written notice subject to any termination provisions in the governing agreement. Upon termination, you agree to pay for all services performed and expenses incurred up to the effective termination date.

11. Governing Law

These Terms of Service are governed by the laws of Nepal, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Kathmandu, Nepal, unless the parties mutually agree to alternative dispute resolution.

12. Changes to Terms

We may update these Terms of Service to reflect changes in our practices or legal obligations. Updates will be posted on this page with a revised "Last Updated" date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
